Business: Apple and ChatGPAT maker OpenAI failed to dismiss a lawsuit filed by Elon Musk’s company X Corp alleging a conspiracy to monopolize the smartphone and generative AI chatbots markets. Apple-OpenAI failed to present arguments to US District Judge Mark Pittman in Fort Worth, Texas to throw out the case.
In his ruling, the judge said Musk’s social media platform The judge said in his brief order that his decision should not be seen as a judgment on the merits of X’s allegations and that he would consider the disputes on the facts at a later stage in the case. Musk’s companies say that Apple has violated anti-trust laws. OpenAI described the lawsuit as consistent with Musk’s ongoing pattern of harassment and said we look forward to proving this in court.
Apple clearly violated anti-trust law
There has been no immediate reaction from Apple and X on the court’s decision. Musk’s companies claimed in the lawsuit filed in August that Apple violated anti-trust laws by specifically integrating ChatGPT into intelligence features on the iPhone and other devices. The lawsuit alleges that Apple illegally excluded rivals from partnering with OpenAI.
OpenAI deal not exclusive
X and Apple, seeking to dismiss the case, said its OpenAI deal is not exclusive. Apple also said that choosing a partner is not illegal in any way.
Denial of anti-competitive conduct
Apple denied any anti-competitive conduct, telling the court that other chatbots are available through browsers and apps, and X and Grok rank high in the App Store charts. In response to the lawsuit, OpenAI accused Musk of waging a legal battle against OpenAI and ChatGPT. Musk is separately suing OpenAI and its leaders in a federal court in California.
